Tech Mahindra Layoff Plan : Senior Employee Prepares to Fight!

This gentleman spoke to us today and gave us details of the “Separation” plan prepared for him by his employer Tech Mahindra. No need to mention that this so called “plan” is illegal and unfair to employees who have given the best years of their lives for the company’s growth.

So what should we do? Read on to find out. 

“I am working in Tech Mahindra for last 17 years and appraisal process for this year is completed. As part of the appraisal process, Tech Mahindra tries to separate several thousand employees this year.

I am rated lower in the appraisal process. I had a call from HR team today for the discussion on my separation:

  1. They mentioned that they will be giving 2 months gross salary as part of separation process. They showed me demand draft taken in my name for the gross salary amount. They asked to take the DD and submit the resignation on my own. [2 months salary for 17 years of work!]
  2. They insisted that it is a good deal as I am getting 2 months salary. If I am not taking this offer, company will initiate the separation process. [That is the usual empty threat]
  3. I refused to resign and I am not sure where this will lead. They have given me 1 day time to think and take up their offer. [that is their generous offer to spoil my career] the resignation offer. I will be having my next meeting with HR tomorrow.

4) I know several thousand employees are targeted for separation this year as part of appraisal process


Last year a HR official asked one of the employees of Tech Mahindra to submit resignation by giving 1 day notice. This audio conversation was leaked and went viral on social media. As result of this, Anand Mahindra had to apologize for the HR act by sending message on Twitter as below:

“I want to add my personal apology. Our core value is to preserve the dignity of the individual & we’ll ensure this does not happen in future,”

We are seeing this repeated this year also and many employees of Tech Mahindra are approaching us. We want answers for the below queries from Tech Mahindra management :

  1. Is this lay off happening with consent of Anand Mahindra? If so, what is the reputation of the company in this regard as they are intentionally repeating this act every year?
  2. Don’t they know Industrial Disputes Act is applicable to IT employees and IT companies have to follow due process for any employment related issues?
  3. Is this planned layoff intimated to the labor department and permission obtained according to the law?
  4. If these acts are happening without the consent of Anand Mahindra, who is driving this? Are they not repeatedly violating legal conditions? They threaten the employees to submit resignation, who gave these HR officers authority to do this?
  5. In case of a planned separation process, employees have to be offered severance package. Companies like Verizon paid 1 month salary as compensation for every year of service. For example, in the senior Tech Mahindra employee case, as he is working for 17 years and he has to be offered 17 months of salary as severance package. His HR is offering 2 months salary as severance package, Is this not cheating of a loyal employees working for 17 years?
  6. Even in such a voluntary retirement scheme, it should be based on the consent of employee. If the employee is not ready to resign, how HR officers has the right to threaten employees. Who has given the authority to these officers
  7. Does Tech Mahindra not know, that affected employees have dependent elderly parents, wife, children studies, loan repayment schedules associated with them. Don’t they have any social responsibility here? Is money making their only agenda?

Many of the IT Companies have greedy corporate mentality and they do not care for their employees. It is now the turn of IT employees in Tech Mahindra to face the pressure. They should resist this forced resignation, join NDLF IT union and fight for their rights.

    Labour department should come up with a long term policy on such conditions.

    Its even possible that such incidences are shown against Indian MNCs only. Most of the IT companies are following such practice. Why target only Tech M?

      It was happened with me also. Tech Mahindra HR forcibly asked to resign and offering 2 months of salary.

    Many seniors are vanishing silently , 2 months salary is very less , many companies settling it with 5 to 7 years salary

      No IT Company HR will amend the policy of notice to 30 days, reason being there will be heavy workload. Their ingenious way of retaining the talent in all these decades has been 6 months probation, 3 months notice and the resource takes 3 months to decide whether to stay or not so 12 months the cost of hiring is absorbed and when he leaves a formality of exit forms are filled and filed never turned open for ages and we have such wonderful organisations existing

    Officially Tech M has reduced the so called retirement age to 55 since last year. Not sure if it’s legal, but hey who cares.. They pay good amount of corporate tax.. Party funds.. Good dividend to investors and great salary to the CEO.. employees… You poor poor fellow…

    Working with Sick India Pvt Ltd from last 6 year.
    And suddenly new management has told to me give resignation by taking 3 months compensation and save your career else they will give termination letter where company will spoil my career.
    And company has also refuses to give my last year incentive.
    Right now I am jobless not getting job also.
    Need your help from NDLF IT union to get right compensation.

      “they will give termination letter where company will spoil my career” – this is an empty threat issued by many HR managers. Don’t resign, file grievance with labour department, join with others to fight for your rights.

      Please send email to with details like your location, when you left the company, how many years you were working there etc. We will take it from there.

        The company Dheeraj referring to is actually SICK and the management of this so called MNC has already ruined the career of more than 50 employees since joining of new MD. This company’s management is grossly misusing their powers for their own vested interest. Let’s join hands to bring such currupt management before the media and to expose them for their unlawful activities!! They are deeply feared of what they have done illegally and therefore targetting old employees just to safeguard themselves.

        This company is an unique composition of currupt management who are misusing their powers against innocent employees for their own vested interests. Any deep investigation by the labour department in this company will expose the management for their harsh and unlawful activities against the employees.

        There is nothing new in this so called MNC. They have standardised their policy of intimidating employees to get the resignation letter signed under a preplanned conspiracy and terminate the services too. They need to be exposed now every where for their harsh and inhuman treatment towards their own employees!!

        Hi newdemocrats,
        After giving low rating for my work, I filed grievances against which no action is taken by them even after a formal call. I have been forced to resign without prior notice, on the spot. I have few evidences to support the wrong practices followed during appraisal. Where can I find help and whom can I contact personally? Please reply.

    All, while sympathy and empathy is given, lets ask ourselves that how much value addition we have done to ourselves and hence to company
    – lets ask is company laying off everyone and shutting down company? If not then, why am i targetted and not others
    – most of companies have bottom 10% layoff every year. What is wrong with letting go bottom performer?
    – if someone has worked for 17 years, how does it prove loyalty? Company was also paying every month
    – finally, lets put torch inside us and see that “ what capability we have developed in last 15-20 years? To keep ourselves competent in the industry. When layoff happens, yes it’s emotional and social setback, but is company only 100% responsible? And we have no liability towarda our career and now we are pushed out of comfort zone, we get angry.
    By the way, i am 20 year IT professional and have seen lot of downturns like . Dotcom burst, y2k burst, lehman collapse etc… but have been in top-10% performer only because of tremendous efforts put by myself.
    Also, i may have interviewed more than 200+ tech mahindra employees and unfortunately everyone was non technical, non functional and only project managerial experience. How will they survive in technology world???
    Guys, our career is in our hands and Indian IT Job market is very hot, but only for competent people.

      My questions to you.
      1. Employee recruited in early 20s with a salary of a few thousand rupees a month.
      2. Employee (bachelor, more physical energy, no other commitments) slogs day and night for the company.
      3. Employee moves up in pay scale and also in social responsibilities (marriage, children, house etc)
      Company makes handsome profits year after year with the hard work of the employee.
      4. Employee after 17 years of working is now approaching 40. Children in high school, home loan EMI still on going.
      6. With age, ability to work long hours decreases. 8 – 9 hours a day is okay, not 14-16 hours.

      Now, company wants to get rid of the senior employee and get a fresh person who will slog 14-16 hours a day for a few thousand rupees a month.

      Sir, this is the strategy of Indian IT companies, don’t blame all employees in general. There may be some specific cases, where some individual would have slackened on the job. But the majority toil hard to earn their salaries.

        Now let us change positions. What do you do with maids at home? Do you not threaten to her to work on less money even when you can pay higher? Dont you (or your family) shout at her for her less than ideal work? Dont you change the maid if she cant adjust according to you but still keep working loyally? Is it not firing like you experienced at your office?

        I also have 14 years of IT experience and can say 50% of the workforce is very dishonest and lacks sincerity. That is work ethics. Technical skill upliftment comes next. Any organization need people who would keep the company in profit. Unfortunately in IT, many people takes fat salaries but in returns does not make juatice to that salary (shouting, arrogance and bossing is not a value addition)

        One more point to note, IT is like any other industry. Respect every profession. This way your changed attitude will land you other jobs. All the best.

          How can can you compare a maid with a IT guy. Maids work in multiple houses and it does not matter if one house terminates them, they can still survive and in the meantime can find other houses. But an IT guy works in only comapny. It’s hightime there should be a strict labour law in india ( like most countries in europe) which protects employees from this kind of sudden seperation.

            3. If after age 40 and 20years of work experience, you still arent more efficient than a 20 year old, you will be replaced by him/her.

            I think the main point here is the legality of the process. There is no need to give it emotional touch by saying someone worked for 17 years. As someone has pointed out, he was getting salary and was not being exploited. So it was a win-win for both. That is what employment agreements are.

            Do Indian laws define what amount should be given in severance packages?
            I think lack of clear laws makes it a gray area so companies are taking advantage of it.

            On the other hand, companies also need some way to get rid of low performers. If they are not able to do that, they cannot do business.

            The need of the hour is a clear law for layoffs.

          With due respect, you can’t justify the shouting and firing of the Maid and then preach about respecting every profession. If an employee can be fired with 1 month notice, even he has the right to switch with 1 month notice.

          In Indian IT MNCs one can either be a manager or a good developer. If he/she is at manager role and does development work only, he/she will never rise to the next level and HRs will fire him/her because he/she does a developers job but is paid a Managers salary. One can never manage 30 team members and do hands on coding.

          There are exceptions, especially those in “technical architect” roles but they are < 5% of the workforce.

      Let me tell you how a person worked for 17 years has proved loyal.
      The employee was not in bottom 10 percent for at least 14 years (assuming they waited for 3 years of underperformance). That 14 years is a long long time of dedication.
      If after that a person has gone underperforming then company is also equally at fault for not investing in persons upskilling.

        You cannot say that working in a company for 14 years is loyalty. As the person may be in comfort zone and did not want to learn new technologies and he was reluctant to learn new technologies and has been working in a long term project.

        We do not know the scenarios or the reasons for working 14 years in a company. so we cannot comment on the situation just knowing that a person worked for 14 years. It all depends on with what perspective you are seeing the situation and nothing more than that.

        Also IT industry is one industry where you need to update your skill set with time else you are no where to be found in the industry (No One questions a very high package to a talented person but everyone questions a layoff !!).

        Finally it the PERSPECTIVE that matters.

      You r among 10% but with so much years spent in IT have you ever seen all team members posses the same skill, have same mental level ….no way not at all…there will be always best better good average bad, now it’s up to the managers how to have right combination and improve their performance. 50% disloyal empoyees is a expected thing … nothing in this world is ideal…there will be odds always u r talking about ideal scenario..good gets its recognition due to bad…layoff is not the only solution.. TechM has many support projects they don’t rotate employees and after few years they turn into useless unskilled prone to layoff guy …. There is a need of strict Labor laws in India as well.

      So many employees getting laid off, while CEO (150+ cr per year) and his sycophants are merrily filling their coffers. Why are those at the topmost level not penalized for poor performance of the company. Why don’t they get replaced? So many wrong decisions have been taken by them (and even admitted by them); why are they not held responsible? Company has no obligations towards the employees (lay them off at a day’s notice), but have 3-5 years of confirmed commitments to retain the top brass! Why? Mr Mahindra, we thought you were a fair and just leader. We needed you to hear us out.

        Why the hell that ceo been paid crores and crores of rupees when people are losing jobs and when their is no enough jobs for the people for daily survivals. This is completely absurd and ridiculous. Those who were working on the ground is thrown away just like that is very horrible to believe. Things should change. Companies should think abt security of the employees and should stop paying huge amt for one individual, it does matter whether it is ceo or any role. They should bring some standards to maintain stability

    My dear Indian IT guy:
    1) Indian law is common across all sectors. If every company is allowed to layoff quoting whatever reason – This gives the chance for the company to bend employees as per their wish. Atleast IT sector requires mental power. There are many sectors which require physical power – For example an employee working in factory. If employer layoff based on performance, they always terminate 40+ employee as physical activity is lesser compare to 20+.
    2) Indian legal system provide retrenchment procedures. The problem here is none of the IT company is following for more profits
    3) Indian law say as part of retrenchment procedure, company has to pay 15 days salary as severance package. Verizon paid 1 month salary for every year of service. If Tech mahindra not even offering this means, they are cheating here – what is ur call
    4) Why Anand Mahindra put the blame on HR officer on video leak call last year. If layoff is legal and company can terminate by giving 1 day notice legally, why he showed sorry face last year to the media
    5) If employees are not performing, it is the responsibilty of company to enhance skill of employee. Is any such training provided for these employees
    6) What is happening here is mere corporate profit making mentality by sucking blood of employees. Every employee will think they are top performers until they get bad rating. You may endup in surprise in coming years even you are top performer, u will be showing exit doors. We are fighting for you also until then continue having mentality of “All is well”

      I agree with you. It’s very easy to say that i am not affected why should i bother on this particular situation but the truth is that you are fostering such kind of practices in the Industry and if you don’t oppose these kind of wrongdoing, someday you will be at receiving end.

    I was victim last year but I didn’t felt bad so neutral emotion in fact after 11 years spending with techm they gave lower rating . It was pleasure that they asked me to resign. Only they should avoide employe satisfaction care servers.

    Super Another IT guy. You compare IT employee with servant maid. The owner of the house as Tech Mahindra. You dont know the fundamentals of employment and there is no point in discussing legal system here. So now govt also can start doing this. For example, if transport sector people ask for salary increase, let them terminate the employee and find new worker. Banks has lot of NPA issue. Let them terminate all senior employees getting higher salary and replace with new employees. Concept if VRS not required as servant can be thrown out same day. Why 2 month salary is reqd. Dont you think everyone do this, Indian economy go for toss. Do you know all IT companies are saying there is no termination to labour offices. Why they are telling this blatant lies if owner can send the servant out on the same day.

    My dear top 10 performing IT guy. Just imagine situation where company has 100 employees. If 10 employees are fired every year as part of bottom 10, imagine situation if company is not recruiting, then top performer will be laid off on 10th year. We are running company here or playing musical chairs. If company next year comes with bottom 25 stratergy, you will be laid off in 4 years. In olden movies, for getting jobs, Jamindhar throw coins from balcony. Thousands of coolies will fight to get the coin. Only people get coins will be given daily jobs. Ladies/old workers will not get job and they die without food. Are you not feeling this bottom 10 concept is similar to that? R u saying corporate companies are modern jamindhars and bottom 10/25/50 is legal

    Simple question from a devils advocate: Would you give the company 17 months salary if after 17 years you get a better offer somewhere else?

    1. No, but it is the company which made 20%+ operating margin every year while employee got only a fraction as salary. The profits are retained as reserves or distributed to shareholders.

      The employee has as much right on the reserves and assets of company (which are created by employees labour) as anyone else, but suddenly left high and dry not being able to provide for family.

      That is the reason, it is fair for the company to pay a hefty compensation to the employee on involuntary separation, not vice versa.

    Dear Rajesh, I’ll make the answer for your query even simple. What is Indian legal system saying. In a bank or govt sectors, if employee opted for volutenry retirement plan (VRS) – Who will pay. Is it company or employee. In these sectors also employee resign as atrition. So it does not mean company can sent employee without compensation. Banks and other sectors may be running in losses and still they offer this. IT companies are running with hefty profits. An employee join IT company at 22. His retirement age is 58. So maximum service an employee can tender is 36 years. So if an employee work for 17 years, he spent 55% of the career. So obviously they have to honour as per legal system. IT companies get tax debates in form of SEZ, get all benefits from govt like uninterupted electricity, water and all other benefits, lands at very lower lease amount and all they are getting only to promote employment to the country. But after getting all benefits, hefty profits, they target employees means, they are sucking employee blood for profit margins. How you say it is correct? Are you saying here that IT companies need not follow legal terms at all? Employees are getting legal matters clearly and nomore companies can cheat quoting performance, faque compliance issues etc

      No point in cribbing. One has to accountable for his career and personal life. End of the day it is business, as long as your skill set and competency is relevant, company will keep you and pay the salary. Please focus you skill and competency, do not depend on any employer. If you lose your job today, one should be able to get the job within couple of weeks. I agree, IT or any other organisation should follow law of the land. As per company has to pay 15.days salary every completed years of experience, it should be paid, collectively we should fight for it. I would end with my favourite quote: love yourprofession not your company.

        The HR in IT has only three jobs : performing rites when an employee joins and rites when he leaves. The third job is pimping layoffs when the top guy wants. HR guys in IT have no skills. They are not laid off because the top guy needs them for dirty jobs.

    Not only tech Mahindra, but many small IT companies are following this process. Even my company that has already released me without even clearing 3 months pending salary is one step ahead. They are showing attitudes or misbehaving when I asked them about when will the dues get cleared and said they will be as per cycle. I am not able to take legal actions due to financial reasons.

    There are no leaders in Tech Mahindra. They are just there to fill a position. When I worked in tech mahindra, they told its a company strategy to fire employees on yearly basis and its nothing new. And the real irony is, one of the Europe head had arranged a special meeting to tell these lines “If you are 10+ years experienced with 10+ lacks package, then please consider you are in red zone”. He calls himself a leader of Europe zone and the CEO tells Sorry! They are putting all their money in buying new firms.. (sorry firms running in losses). By sucking all the profits from their IT company. See mahindra two wheeler.. big flop.. Scorpio?? They just got what they invested for their R n D. Still surging on their tractor business! Anand Mahindra is just continuing the heir with no leadership qualities. Pardon me if any TechM supporters are there.. within 6 months of my joining, they started these firings concept and they said as u recently joined 90% there is no chance that u would be fired but if u get a call please inform us immediately!! Now tell me where are the ethics

    Thank you HR guy. I hope u r an HR officer. We really appreciate your effort for standing in side of employees and fighting for the rights of employees in getting severance package. Based on your statement, we are both in same page that company has to offer severance package. If companies are not paying that, it means they are not following legal process. If you are HR, i believe you would know all steps to be followed in retrenchment process. If i paid for any claim, it does not mean u can repeat the crime. If company has to retrench, they need to inform labor dept and get their consent if they are having more than 100 employees. They have to retrench newly joined employees first. If they recruir later, they have to take retrenched employees. This is what law says. If you skipped this portion in your sylabus, refer this link I hope u agree with ur stand that company has to stand as per law of land and continue your support in all these points

    It was happened with me though you get excellent ratings. Tech Mahindra HR forcibly asked to resign and offering 3 months of basic salary. If you say no then you should be ready for termination. They are talking a lot about ethics and values but seems they never follows. There policy is just to Hire n Fire…

    Let’s unite and fight back against dictatorial style of IT companies, be United and then only they will hear you else that are using same British technique divide & rule

    We all agree and sign during employment that ‘company has the right to terminate your services as per the requirements’ !! So if one don’t want to accept and argue on this the boss of your own company, as any other company may leave you at any point of time !!

    There is unemployment crisis in India and people for getting jobs can sign any condition company say. In this case, company can misuse the condition. But as per legal terms, agreement of 2 parties will be superceded by land of law. In all cases, land of law is more powerful. For example, if employee sign that he and his entire family are slaves in getting job for the company, it is not valid. If finance company ask 120% interest for lending money and lender also sign, it is not valid. Reason is slavery is illegal and more interest is illegal. So legally company cannot terminate employee based on condition written in offer letter. Refer NDLF article in this link for more details:

    As a group they have very poor ethics, when it comes to business, employee relationship etc and if Mr.Anand Mahindra is the go to person every CEO and HR are the one s to be sacked first. They have something called the Rise and this germinated from the Auto business but did not find its roots in their other verticals be it their IT or Leisure business. Was surprised that they had 3 Corporate HR heads for one division , but none of them took initiative even to review their policies or make a serious note on their exit policies or practices. But ironically they boast them as the best places to work…… Doesn’t seems so

    Tech Mahindra is a company which pays 200+ crores to a CEO, who satisfies share holders, Anand Mahindra and others. Clients are kept happy by keeping employees insecure and scared. They are not paid on par with peer IT companies.
    All the profits are used to buy companies which doesnt help Tech Mahindra growth but helps other Mahindra group companies.
    The focus is only profitability not Growth in revenue.
    Anand Mahindra or CEO just talk funda and values and ethics are totally missing in the company DNA.

    IT is a hire and fire industry. Didn’t all of you cribbers know it when you joined? If you wanted job security, you should’ve joined the government. I’ve worked in tech m too – and I know the level of talent there. Most of you are sub standard and know you won’t get employed anywhere else. That’s the real reason why you’re cribbing. Instead focus on building your skill sets. If you’re good – another job is ready and waiting for you. That’s the harsh truth – but of course, if you were to see it that you, you already would have.

    I worked in Pune office of tech mahindra due to marathi fanaticism, all south indians are given low rating and being fired.

    anad mahindra is the culprit who targeted the salaries of Tech employee and converted nasscom from a industry body into cartel.

    This man very dangerous and thro his media outlet (he own mumbai media house business standard new paper) controls and get paid news published which tries to create negative image out of senior employees (like they are outdated, cant learn etc).
    Mr mahindra is paying undreds of rores to ruling party to keep them business friendly and as out dear Modi looks the other way the traditionas Indian business families have taken over IT sector and making merry using huge unemployment problem in the country.

    I came back from my maternity leave and as for 6 months the company could not do ask me to leave, the 7th month they asked me to leave after rating me low giving the reason that since you were on Maternity, we could not rate your work. Out of 12 months, I was away for 4 months only and this absurd reason just could not digest in me. The same happened with other females too who came back from maternity. Some of them saved their jobs by moving in other teams and some had to leave eventually.

    1. This is against several laws. Maternity leave is a legally guaranteed leave, and they can not penalize an employee citing the leave of absence as reason.

      Tech Mahindra is not the only company to mistreat their employees but plenty of such kind!!
      Let’s highlight such companies and brought to the electronic media who are playing with the career of their own employees for no valid reason. This has become a national problem due to which employees are compelled to lead a life of slavery.
      Employees get a job only after going through a long process of a company not to suffer in to hands of these goons but to enjoy his career fearlessly and plan his future accordingly.
      Somehow this common problem has to be given a form of a movement against corporate sector!!

    Similar situation was faced by an employee I know of couple months back who was asked to take massive reduction in salary. When he refused they handed him over with a termination letter and threat to sue in court.

    My 2 cents to the crowd who wish to work in IT sector and wish to live a healthy, family oriented & peaceful life.

    1st Cent : Never work for an IT company of Indian origin, such as, Infy, TCS, Tech-M etc etc… If you are working there, then get out from there ASAP.

    2nd Cent: Work in a product company and never work in a services company.

    If you can’t do two of the above things, then become ‘Jumleybaaz’ and your Ache Din will arrive in ‘Petaflops’.

    3. work on low wages or leave the company.

    Karma returns, Thats exactly the tactics of IT companies which divide and rule. They give perception that you are controlling the company, u have power. An employee is not removed based on performance. They set bottom10 target. They dont want to disturb less than 5 years experience pool as their salary is less. They want to reduce 10% of people who are greater than 5 year experience. For example, if project has 100 people are there, 10 people to be identified as bottom 10. 30 people will be less than 5 year experience. So they want to remove 10 people from remaining 70. Overall it comes to 15% in senior category. In this fashions, managers are more affected. But they created perception that managers are responsible for all people exit but reality is company decision. Here all managers,hr officers are also salaried workers. If u take last year incident, HR manager asked the employees to resign based on management decision. But when this is leaked, blame is put on HR officer and she is made as scapegoat after Anand appology. So managers are scape goats of corporate greedy profit making mentality and divide and rule principle

    I am a IT professional at techmahindra Hinjewadi pune. There are unfair and forceful termination are going on in techmahindra Hijewadi Pune office, that should be cause of upcoming suicide case.

    Another part of the story is….an employee has resigned, but his release is not being sanctioned as heirarchy of Tech Mahindra wants to emphasize that “we will kick you out” as per our plan. I know the employee personally.

    Is Tech Mahindra having BONDED LABOUR???

    Currently layoff is going on in Tech Mahindra If you are in U band and are in 90 days in bench or in P band and are in 45 days in bench, expect calls from your “friendly” HR person anytime.
