Union in IT Sector! Hurdles Overcome!
Put an End to Injustice and Exploitation!!

Dear Friends,

We belong to New Democratic Labour Front (NDLF) – I.T Employees Wing. We have been working to unionize IT employees for the past one and half years.

From daily wage earners to corporate in IT sector, every section of society have a Union of their own to safeguard their interests. While lobbying with government and propagating their views in society using their association NASCOM, the IT companies place direct and indirect hurdles for IT employees to form a Trade Union. In the absence of Union they are able to deny the employees all legal rights such as regular working hours, protection from sudden and arbitrary dismissal etc.

To cap them all, in December 2014 TCS decided to lay off 25,000 senior employees at one go. Against this unjust and unfair move, NDLF launched a struggle in Chennai OMR and on January 10, 2015 formed the first labour union in India for IT employees.

In the same month, we filed a Public Interest Litigation in Chennai High Court asking the court to confirm that Industrial Disputes Act 1947 is applicable to IT companies. The court passed an order asking Tamil Nadu government to spell out its decision on this matter immediately. However, the government delayed for 15 months, and sent a reply to our petition only on May 30, 2016.

According to the government’s stand

IT company employees are free to form trade union.

All the labour legislations are applicable to all the IT and ITES companies. No IT industry has been exempted from the provisions of the Industrial Disputes Act 1947.

IT employees can redress their grievances through evoking the provisions of Industrial Disputes Act 1947.

As a result of our efforts, Tamil Nadu government has thus legally confirmed our right to formUnion. This is only the beginning, to complete this victory we should organize ourselves as a Trade Union and realize our demands.

What can be achieved through Trade Union?

Put an end to the ever present, ever terrifying oppressions like Pink Slip, Forced Resignation and sudden Termination

Put an end to the unjust, unfair and unscientific appraisal system.

Ensure job security and promotion as a right.

Realize democratic demands like 8 hours work day

Abolish gender discrimination in work place, compensation levels and promotion. Win facilities provided under law like creche for employees’ children, maternity leave for expectant mothers etc.

All these can be carried out only by a labour Union registered under Indian Trade Union Act 1926. At present, NDLF – I.T Employees Wing is the only Trade Union of IT employees registered under this act
